How to Properly Calculate Overtime

Did you know that overtime is based on the regular rate of pay, which is the compensation you normally earn for the work you perform (not less than minimum wage); AND

The regular rate of pay also must include a number of different kinds of remuneration including but not limited to:

  • Piecework earnings;
  • Commissions;
  • Non-discretionary bonuses; and even
  • No Benefit Allowances (a recent court ruling)
